The Council of the EU approves new rules for foreign subsidies to EU companies

Credits: pexels.comThe Council of the European Union has given its green light to the Foreign Subsidies Regulation. The final text aims at addressing the distortions created by subsidies given by non-EU states to companies operating in the European single market.

In particular, the new legislation has the objective to restore fair competition within the internal market. Two new tools will be now available for the Commission to investigate financial contributions by a public authority in a non-EU country:

  • two prior authorisation tools to ensure a level playing field for the largest mergers and bids in large-scale public procurement procedures;
  • a general market investigation tool for investigating all other market situations, as well as lower-value mergers and public procurement procedures.
